Green Cards through Investment (also called the Fifth Preference Green Card or EB-5)

The US immigration structure provides an investment-based pathway to obtaining a Green Card, formally known as the Fifth Preference Visa or EB-5 program. Launched in 1990 by the Immigration Act of 1990, this route grants eligible foreign investors the opportunity to acquire conditional, and later permanent, residency. The central criterion is a substantial capital investment in a commercial enterprise within the United States. As of 2021, the minimum required investment is $1.8 million, or $900,000 if the investment is in a targeted employment area (TEA) — a rural or high-unemployment zone. The investment should be capable of generating or preserving at least 10 full-time jobs for qualifying U.S. workers within two years of the investor’s admission to the United States as a conditional permanent resident.

The investor must be active in the management of the company.

The immigration law requires the foreign investor to assume a role of significance in the new commercial venture, highlighting the necessity of active participation. This means investors cannot be passive contributors, they must be involved in the day-to-day management or policy-making of the company.

The nature of this engagement could vary; an investor might be part of the company’s managerial group, executing daily operations and strategic decisions. Alternatively, they could take on a policymaker’s role within the company’s board of directors. It’s this proactive participation that differentiates EB-5 investors from mere financial contributors.

Such active involvement underpins the program’s intent to spur economic activity and create jobs. By placing the onus of direct management or policy decision-making on the investor, the EB-5 program ensures that the investment leads to productive use, aligning with the fundamental goal of job creation.

This involvement in management is closely scrutinized during the I-829 petition process, wherein the investor must demonstrate that the job creation requirement has been fulfilled. Failure to prove active participation can result in the rejection of the petition and potential loss of conditional resident status.

Green Card Investment Annual Quota:

The U.S. government sets aside an annual quota of 10,000 Investment Green Cards specifically for the EB-5 program. It is noteworthy that this quota solely applies to the primary applicants – the investors themselves. Immediate family members such as spouses and unmarried children under the age of 21, who may accompany the primary applicant, do not count towards this limit. This provision allows for the total number of individuals obtaining Investment Green Cards through the EB-5 investment pathway to exceed the defined annual quota, potentially benefiting more than 10,000 individuals each year, contingent upon the number of accompanying relatives per primary applicant.
