Obtaining a Green Card by marrying a Green Card holder

IMPORTANT: The sponsoring spouse (legally married husband or wife) can be a U.S. citizen or permanent resident (Green Card holder). If the sponsoring spouse is a Green Card holder, you should download the application guide on this page. However, if the sponsoring spouse is a U.S. citizen, you should download the “Green Card through Marriage to a U.S. Citizen Application Guide”.

A foreign national who wants to live and work permanently in the United States must first become a permanent resident; he or she must obtain a green card. One way to obtain a green card, or permanent resident status, is through marriage to a person who is already a permanent resident in the U.S. Spouses and children of permanent residents in the United States qualify for green cards as long as they are otherwise eligible, and their permanent resident husbands or wives are willing to act as their sponsors. In the Green Card through Marriage to a Green Card Holder Application Guide, you will learn more about what the requirements are to qualify for a green card through marriage to a permanent resident in the United States. The guide also takes you through the process of applying for a green card through a sponsoring husband or wife.

A foreign citizen can qualify for permanent residency in the United States – otherwise known as a green card – if he or she marries someone who is already a U.S. citizen or a permanent resident – a green card holder. The U.S.-resident spouse or fiancé(e) must be willing to act as a sponsor for the green card applicant, and must have the financial means to support the foreign citizen wife or husband economically. There are no educational requirements to qualify for a green card through the sponsorship of a permanent-resident husband or wife.
